Please read these Terms of Service ("Terms") carefully before using the Jointly mobile application ("App") operated by Jointly ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using the Jointly app, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Jointly is a budgeting application designed for couples to track shared and personal expenses. The App allows users to:

  • Create and manage shared budgets
  • Track personal spending
  • Connect with a partner to share budget data
  • View spending analytics and reports
  • Receive notifications about budget status

3. Account Registration

To use Jointly, you must create an account using Sign in with Apple. You are responsible for:

  • Maintaining the security of your Apple ID
  • All activities that occur under your account
  • Providing accurate information
  • Notifying us of any unauthorized use of your account

4. Partner Connection

Jointly allows you to connect with one partner to share budget data. By connecting with a partner:

  • You consent to sharing your budget and transaction data with that partner
  • You understand that your partner will see shared budget activity in real-time
  • You can disconnect from your partner at any time through the app settings

5. Subscription and Payments

Jointly offers both free and premium subscription tiers:

  • Free Tier: Basic budgeting features with limited budgets
  • Premium Tier: Full access to all features including unlimited budgets, advanced analytics, and satisfaction tracking

Premium subscriptions are billed through Apple's App Store. By subscribing:

  • You authorize Apple to charge your payment method
  • Subscriptions automatically renew unless cancelled
  • You can cancel anytime through your App Store settings
  • No refunds are provided for partial subscription periods

6. User Conduct

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer or decompile any part of the App
  • Share your account credentials with others
  • Use the App to harass or harm others

7. Intellectual Property

The App and its original content, features, and functionality are owned by Jointly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. User Content

You retain ownership of any data you enter into the App (budgets, transactions, notes). By using the App, you grant us a license to store and process this data solely for the purpose of providing the service.

9. Data Storage

Your data is stored using Apple's CloudKit service. We do not guarantee the permanent storage of your data. You are responsible for maintaining your own backup of important financial information.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • The results obtained from the App will be accurate or reliable
  • The quality of the App will meet your expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOINTLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or other intangible losses
  • Financial decisions made based on App data
  • Unauthorized access to your data
  • Service interruptions or errors

12. Financial Disclaimer

Jointly is a budgeting tool and does not provide financial advice. The App is intended to help you track spending, not to provide investment, tax, or financial planning advice. Always consult a qualified financial professional for financial decisions.

13. Indemnification

You agree to indemnify and hold harmless Jointly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

14. Termination

We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by deleting your account through the App settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

20. Entire Agreement
